Mirus Biosciences Suit against Fugent Dismissed

On September 14, 2011, Mirus Biosciences, LLC sued Fugent, LLC for patent infringement, and approximately 3 months later, on December 23, 2011, the attorneys for Mirus Biosciences, LLC filed a dismissal of the suit with prejudice according to attorneys from Haus, Roman and Banks, LLP. Mirus Bio, LLC vs. Fugent, LLC, Case No. 11-CV-630-slc, U.S. District Court, Western District of Wisconsin.

In the suit, Mirus alleged infringement based, in part, on the making and sale of Fugene®6. Fugent is the exclusive manufacturer of Fugene®6 and Fugene®HD. Fugent is now free to continue commercializing Fugene®6 and Fugene®HD for use by its customers, without further legal challenge by Mirus. The litigation was resolved to Fugent’s satisfaction and with no monetary compensation or other damages being paid by Fugent to Mirus.

Fugene® products are widely used, and currently referenced in thousand of publications, over 1300 issued US patents and almost 3700 published US patent applications.
