The cabinet meeting on Tuesday 18, January 2011 has come to the following decision:
Cabinet approved in principle the draft of regulation of Prime Minister’s Office on Board of Provincial Governance (No. ...) BE .... as the Office of Public Sector Development (OPSD) proposed and assigned the audit committee to verify the regulation draft the draft of subordinate legislation which has already been proposed to the Cabinet for further implementation.
The essence of the draft
1. Requirement that the representatives of local government be comprised of at least one member from provincial administration office, one alderman, one or two representatives from district government varied by cases (Draft No. 3, Rev. No. 6)
2. Establishing the procedure for allocating local committee representatives of local government, list of the elected and the alternates, and the retirement of a committee member before rotation (Drafts No.4-7, Revs No. 10, 13, 16, and 20
3. Establishing the transitory position demanding that local committee representatives perform their duty until completing the rotation and in case the list of qualified candidates not established, implement the allocation within 60......... (Drafts 8-9)
The Cabinet acknowledged and agreed on the principles proposed on January 18th 2553 B.E. by Office of the National Economic and Social Development Board. The details are as follows;
1. The Cabinet acknowledged the meeting outcome of Office of the National Economic and Social Development Board 2/2553 and the results of the consideration and agreement of Commission of National Creative Economic Policies
2. The Cabinet approved on principles of request to revise the regulation of Prime Minister’s Office on actuating National Creative Economic Policies 2553, No.10, Paragraph 2 from “The Prime Minister shall designate one official as chairperson to be responsible for administration and general governance of Office’s affairs” to be “The Prime Minister shall designate one governmental authority as chairperson to be responsible for administration and general governance of Office’s affairs” and the audit committee assignment to verify the regulation draft the draft of subordinate legislation which has already been proposed to the Cabinet and the assignees shall take the suggestions from the Cabinet Secretariat into consideration and further implementation.
The Cabinet approved as proposed by the Ministry of Finance as follows;
1. The Cabinet agreed in principles on the assisting measures proposed by the Bank for Agriculture and Agricultural Cooperatives and approved the budgets to compensate the loan interest that the farmers would have to pay the Bank.
2. The Cabinet agreed in principle on the assisting measures proposed by the Ministry of Agriculture and Cooperatives and allocated the budgets for the Cooperatives Promotion Department to proceed.
However, all related agencies shall brainstorm about the details of budget distribution later.
The Cabinet approved as proposed by the Ministry of Labour as follows;
1. The Cabinet agreed in principles on Draft decree to establish rules and contribution rates; benefit representation type, as well as criteria and conditions of rights to receive the benefit instead of the insured person. Year ......... as proposed by the Ministry of Labour and assigned Office of Juridical Council to verify the draft and take further implementation.
2. The Cabinet approved to withdraw Draft decree to establish rules and contribution rates; benefit representation type, as well as criteria and conditions of rights to receive the benefit instead of the insured person per Section 40. Year ......... (based on the Cabinet agreement on December 8, 2552) out of the phase of consideration by Office of the Juridical Council
3. The Cabinet assigned related agencies to review the structure of divisions under the Department of Public Welfare, The Ministry of Labour and additional framework for the aforementioned department to be in accordance with government’s urgent policies per Thailand Development Plan to create social security system for off-system labours and propose for the Cabinet’s consideration by the end of February 2554.
The Cabinet approved that the Ministry of Tourism and Sports to carry on the project to protect immigrant influenced by riots until March 31st, 2554 as approved by the Cabinet on March 2nd 2553 and allow the Ministry of Tourism and Sports to have financial commitment before receiving the period budgets and financial commitment over the fiscal year per the implication of Section 23 of the Budget Procedure Act 2502 (revised) exceptional for the creditors proposed by the Bureau of Budget
The Cabinet agreed and approved as proposed by the Ministry of Industry as follows;
1. The Cabinet agreed in principles on the comprehension document draft of the Model Project for an Environmentally Conscious High-Efficiency Arc Furnace cooperation between the Department of Industrial Promotion and New Energy and Industrial Technology Development Organization : NEDO) from Japan. If it is necessary to adjust the comprehension document draft in the insignificant parts, the Department of Industrial Promotion is authorized to do so by cooperating with the Department of Treaties and Legal Affairs, Ministry of Foreign Affair.
2. The Cabinet agreed that the Director-general of the Department of Industrial Promotion or his representative to sign on behalf of Thailand.
3. The Cabinet designated the Ministry of Foreign Affairs to prepare the proxy (full power) to authorize the Director-general of the Department of Industrial Promotion or his representative to sign on the comprehension document draft of the Model Project for an Environmentally Conscious High-Efficiency Arc Furnace
4. The Cabinet approved in principles that the Department of Industrial Promotion is the ownership recipient of machinery and equipment of Model Project for an Environmentally Conscious High-Efficiency Arc Furnace from NEDO; in the part of transferring ownership of assets in such Project, the Ministry of Industry shall present the details to Committee on the Supply, Department of Comptroller for consideration.
To make an agreement with foreign countries on Model Project for an Environmentally Conscious High-Efficiency Arc Furnace or similar cases in the future, the Ministry of Industry shall consider patenting the inventions as a result of the Project.
The essence of the Topic
The Ministry of Industry reported that the comprehension document draft of the Model Project for an Environmentally Conscious High-Efficiency Arc Furnace is purposed to promote cooperation between Thailand and Japan which is in accordance with government’s policy to reserve energy and conserve the environment in term of promoting continual industries by adding values and get an income from wastes or used items, resulting in national economic benefits as it compensates the imports of raw materials and energies from foreign countries, lessens energy consumption and carbon dioxide emissions better national environment, creates capacity to compete and gain more income for steel and stainless steel industries, elevates the development of national technologies, does not change Thailand’s territory or outside territory under Thailand’s sovereignty or power per international contract or laws or have extensive impacts on Thailand’s economy and society, or have commitments significantly in term of national trading, investment, or budgets, can be practiced without issuance of an act to conform to the contract, and its budgets have already been allocated. Therefore, the Ministry determined that the comprehension document draft of the Model Project for an Environmentally Conscious High-Efficiency Arc Furnace is not a contract per Section 190 paragraph 2 of the Constitution, which requires approval from the parliament before any committed implementation.
The Cabinet approved as the proposal of the Ministry of Foreign Affairs as follows;
1. The Cabinet approved the extension of duration to proceed the Project of Scholarship Allocation as requested by the Ministry of Foreign Affairs, 3rd phase for 5 years more (Fiscal year 2549-2553)
2. The Cabinet approved the allocation of 40 scholarships, which are the scholarships left under 100 existing scholarships.
3. The Cabinet approved on the spending of the budget left at the total of 303 million baht, which is left under the existing 700 million baht approved by the Cabinet.
4. The Cabinet has agreed on the allocation of 8 scholarships/ year as the scholarships for any citizen and the scholarships for official’s development (if any year in which no delegate is qualified, the scholarship shall be included with the following year). The Cabinet assigned the committee to verify the scholarship details of a specific project and allocate the scholarship as requested by the Ministry of Foreign Affair in the 3rd phase to consider about the ratio of scholarship need for a specific type, degree, fields, and targeted countries to be in accordance with the strategy to proceed the policies about foreign affairs of Thailand in each year.
