The cabinet met on Tuesday, October 29, 2013. Some of the decisions are as follows:

Title: Draft Act on Amendment of Royal Decree on Special Purpose Entity for Asset Securitization B.E. 2540 B.E. ...

Following Office of the Council of State?s suggestion, the Cabinet agreed with Draft Act on Amendment of Royal Decree on Special Purpose Entity for Asset Securitization B.E. 2540 B.E. ..., that has been scrutinized by Office of the Council of State, and approved to forward the Draft Act to the collaborative council of the House of Representatives for consideration before proposing to the House of Representatives.

Significant items of this Draft Act examined by Office of the Council of State are as follows:

1. Definition of ?special purpose entity?, ?asset securitization?, ?assets? and ?assets dealer?

2. Obligations of Securities and Exchange Commission

3. Regulations on the registration of special purpose entity

4. Authorities of special purpose entity

5. Exemption from obligation to Civil and Commercial Code on Assignment of Claims

6. Exemption of fee for transfer and modification of registered transactions

7. Subrogation of litigants of special purpose entity

8. Presumption for appropriate pricing of assets transfer

9. Penalization

10. Transitory provisions

Title: Rice farmers aid B.E. 2555/56

The Cabinet agreed with resolution made by the first Cabinet Subcommittee (economic) in its 12/2556 meeting on October 28, 2013 chaired by Deputy Prime Minister Niwatthamrong Boonsongpaisan, on the following Ministry of Agriculture and Cooperatives? suggestion on special assistance to rice farmers who could not exercise their rights (for the second time) to join rice-pledging scheme for B.E. 2555/56 of which the deadline was on September 15, 2013 as a consequence of Ministry of Agriculture and Cooperatives? request to farmers to postpone farming and the delay in releasing irrigation.

The Cabinet assigned provincial level rice-pledging subcommittee to supervise and provide assistance in accordance with procedures, rules, and regulations, in order to ensure farmers? actual benefits corresponding to exact quantity of rice sold and not exceeding quantity indicated in farmers? certification.

Title: Extension of opening hour of Thai-Cambodia permanent crossing points

Following Ministry of Interior?s proposal, the Cabinet agreed with extension of opening hour from 0700-2000hrs to 0600-2200hrs for the following five Thai-Cambodia permanent crossing points:

1. Ban Laem permanent crossing point, Pong Nam Ron District, Chanthaburi

2. Pak Kard permanent crossing point, Pong Nam Ron District, Chanthaburi

3. Hat Lek permanent crossing point, Klong Yai District, Trat

4. Klong Luk permanent crossing point, Aranyaprathet District, Sa Kaeo

5. Chong Chom permanent crossing point, Kap Choeng District, Surin

Title: Request for approval for the signing of Intergovernmental Agreement on Dry Ports

Following Ministry of Transportation?s proposal, the Cabinet,

1. Agreed with the signing of Intergovernmental Agreement on Dry Ports.

2. Approved Transportation Minister or an authorized person as the signatory of the agreement on behave of the Thai Government.

3. Assigned Ministry of Foreign Affairs to issue Full Powers for the signatory and to prepare text for ratification reservations.

4. Assigned Ministry of Foreign Affairs to prepare instrument of ratification to present to Economic and Social Commission for Asia and the Pacific (ESCAP) on the day of signing.

Gist

Intergovernmental Agreement on Dry Ports is approved by Economic and Social Commission for Asia and the Pacific (ESCAP) in its sixty-ninth annual meeting in April, 2013 with an aim to declare the intent of ESCAP member states towards the development of dry ports to continuously integrate different types of transportation with international logistics. Following are the important points of the Agreement:

1. Definition of and related implementations.

2. Identification of internationally-important dry ports in Annex 1.

List of dry ports of international importance appearing in Annex I include 153 dry ports and 87 potential dry ports in 27 countries, 3 of which are in Thailand: Ladkrabang Inland Container Depot in Bangkok, Chiang Khong Intermodal Facilities in Chiang Rai (potential dry port), and Natha Intermodal Facilities and Container Depot in Nong Khai (potential dry port).

3. Guiding Principles for the development and operation of dry ports are in Appendix 2.
