The cabinet meeting on Tuesday 4, December 2007 has come to the following decisions:
* The cabinet approved the signing of the agreement between the Kingdom of Thailand and the Lao People’s Democratic Republic for construction of the third friendship bridge between Nakhon Panom and Khammouan as proposed by the Ministry of Transport as follows:
1. Approved the signing of the agreement between the Kingdom of Thailand and Lao People’s Democratic Republic for construction of the third friendship bridge between Nakhon Panom Province and Khammouan Province
2. Designated the Minister of Transport or his representative to sign the agreement as mentioned above, and assigned the Ministry of Foreign Affair to issue the full power document for the Minister of Transport or his representative
The main points of the agreement mentioned above are as follows:
1. This project is located on the Thai side at Baan Hom, Tambon Arjsamart, Amphur Muang, Nakhon Panom Province, and on the the Laos side at Baan Wern Tai, Muang Tha Khaek, Khammouan Province
2. The Thai government will provide funding for the government of Laos in return for the rights for the survey, design, control of construction of the bridge, the road link to the bridge, and control of the entire construction project on both sides of the border for this project
3. The government will search for an area suitable to accommodate the construction for the project without charge until the completion of the project and will accommodate all issues and guarantee paperwork in Laos including documents for enter and re-entering Laos for Thai workers and their family members.
4. The organization responsible on the Thai side is the Ministry of Transport, Department of Highways. On the Laos side it is the Ministry of Communication, Transport, Post and Construction, Lao People's Democratic Republic.
5. The rights of the project for each country will be in the middle part of the bridge.
6. All details mentioned in this agreement will not affect the border of Thailand and Laos according to the international law.
7. Thailand will be responsible for design, control of construction, expenses, and all construction costs of this project.
8. The two countries will establish a committee to coordinate the project with a management committee to manage and oversee the project.
9. The management committee will work together to search for and establish a clear construction site before the commencement of this project.
10. Laos will make tax exempt the cost of the all construction, materials, equipment, vehicles and transportation that will be used in the project and personal use of Thai workers.
11. After the bridge opening the responsibility of management and repair of the bridge will be shared by the two countries including responsibility for safety.
12. Before completion of the project the two countries will discuss traffic flow on the bridge, tolls, repair work of the bridge and discuss ongoing management and maintenance of the bridge.
13. Set up a traffic interchange point to be in Lao’s.
* The cabinet approved the United Nations Convention against corruption B.C 2003 as proposed by the Ministry of Foreign Affairs the following:
1. Propose the United Nations Convention against corruption B.C. 2003 to the National Legislative Assembly for suggestions and recommendations and submit an English version of the convention to utilize as an addendum for scrutinize process.
2. Assign the Ministry of Foreign Affairs to ratify the convention with the reservation in the ratification that “In accordance with Paragraph 3 of Article 66 of the convention, Thailand does not consider itself bound by Paragraph 2 of the same Article.”, after the convention has been scrutinized by the National Legislative Assembly
2.1 The draft bill of the revision of the Criminal Code (copy..) B.E.... (To add the meaning of “foreign government official” and “foreign organization official” to add the penalty for the official and the penalty for the government position related to the foreign government official or foreign organization official to add the postponement of the trial and add the penalty related to administration)
2.2 Draft a bill of assets acquired through corruption B.E...and to set up a method to monitor and claim back assets acquired through corruption
2.3 Draft a bill of revision for international cooperation in criminal acts B.E 2535 (copy...) B.E... (Revision in principle of international cooperation related to confiscation, seizure, forfeiture of asset) includes three copies which have been affected
3. Designate the Ministry of Foreign Affairs for future proceedings according to article 190 of the Constitution of the Kingdom of Thailand before ratification of the convention
* The cabinet approved the application for membership of the Paris Convention for the Protection of Industrial Property and Patent Cooperation Treaty as proposed by the Ministry of Commerce the following:
1. Agreed to become a member of the Paris Convention for the Protection of Industrial Property and Patent Cooperation Treaty and proposed a convention and treaty to the National Legislative Assembly to scrutinize according to article 190 of the Constitution of the Kingdom of Thailand chapter 2 before assigning the Ministry of Foreign Affairs for future proceedings to become a member of the convention and treaty as mentioned above. It is not necessary to proceed according to article 190 chapter 3 as this convention and the treaty mentioned above have been affected therefore no future discussion is required.
2. The ministerial regulations drafts copy...( B.E....) which is a revised ministerial regulations copy 21 (B.E 2542) issued according to the patent act B.E 2522.
