The cabinet meeting on Wednesday 2, June 2010 has come to the following decision

Draft regulation determining principles, methods, and conditions in seeking permission and issuing advertisement licenses of narcotics and narcotics addiction rehabilitation B.E....

The Cabinet approved the Draft regulation determining principles, methods, and conditions in seeking permission and issuing advertisement licenses of narcotics and narcotics addiction rehabilitation B.E...., which the Office of the Council of the State had already reviewed as proposed by the Ministry of Public Health, and granted to be operated.

Content of the draft regulation

1. Granted only narcotics in category 2 or 3 to be publicized (Draft no.1)

2. Determined principles, method, and condition of approval, seeking permission, issuing the license, and requesting reissued advertisement license of narcotics and narcotics addiction rehabilitation (Draft no. 2-4, Draft no. 6-9, and draft no. 11)

3. Determined codes of conduct for the narcotics and narcotics addiction advertisement license holder (Draft no. 5 and draft no. 10)

4. The Secretary General of the Food and Drug Administration was the determiner of permission request form, license, and reissued license (Draft no. 12)

The Cabinet approved the draft regulation determining principles and method of filing appeals and method of considering appeals on narcotics and narcotics rehabilitation advertisement B.E..., which the Council of the State had reviewed as the Ministry of Public Health proposed, and granted to be operated.

Content of the draft regulation

1. Determined filing appeals required issuing a letter according to the determined principles, which could be filed by oneself or by registered mail within the timeline. The appellant could ask for correction or addition on the appeal, including withdrawing the appeal according to the determined principles (Draft no. 1 — draft no. 3 and draft no. 6)

2. Determined considering appeals principles and methods of the appeal commission and appeal result notification of the commission to the appellant (Draft no. 4 — draft no. 5, and draft no. 7-9)

Taxation measure to support establishing regional operation office

The Cabinet approved the draft Royal Decree issued under the Revenue Code on decrease of value and revenue exemption (Issue No...) B.E.....as the Ministry of Finance proposed.

Content of the draft Royal Decree

Additionally corrected the draft Royal Decree issued under the Revenue Code on decrease of percentage and revenue tax exemption (Issue No. 405) B.E 2545 to reduce the percentage and exempt the revenue tax for the regional operation office and aliens who worked in the regional operation office, including companies and juristic partnerships holding shares in the regional operation office. The gist is as following.

1. Reduced the revenue tax for the regional operation office and maintained tax collection at 10 percent of the net margin of the revenue from service in Thailand.

2. Exempted the revenue tax from the net margin received from service in foreign countries for the regional operation office

3. Reduced the revenue tax for the regional operation office and maintained tax collection at 10 percent of net margin from these kinds of revenue; (1) Royalty received from associated enterprises, only occurred from the result of research and technology development conducted in Thailand. (2) Interest received from associated enterprises, only interest from the loan for associated enterprises.

4. Exempted the revenue tax on dividends received from associated enterprises for the regional operation office.

5. Exempted the revenue tax on dividends received from the regional operation office for the companies and juristic partnerships which were established in accordance with the laws of other countries and did not operate in Thailand.

6. Reduced the withholding tax rate for the alien working in the regional operation office and maintain tax collection rate at 15 percent of revenue in case of the assessable income which the alien received from hiring labour by the regional operation office.

7. Exempted the revenue tax for the alien working in the regional operation office in case of hiring labour occurring from sending the alien to work abroad.

Report of review result on qualifications of small schools deserved to receive budget to support cost per head according to the Cabinet resolution on 27 October 2009

The Cabinet acknowledged report of review result on qualifications of small schools deserved to receive budget to support cost per head according to the Cabinet resolution on 27 October 2009 as the Ministry of Education proposed. In the part of additional budget allocation to schools since the first semester of the year 2010, the fiscal year 2010 budget had not been saved for this matter, the Office of the Basic Education Commission, therefore, had to adjust the action plan and the budget disbursement plan in the fiscal year 2010 from the scheme of 15-year-free education which the budget of 40,604.6911 million baht was allocated to. As for the expense in the fiscal year 2011, the Ministry of Education proposed to put it in the budget of the Office of the Basic Education in the fiscal year 2011 at the amount of 888.70 million baht as approved by the Bureau of the Budget.
