The Entry into Force of the Agreement between the Kingdom of Thailand and the Kingdom of Cambodia on the Transfer of Sentenced Persons and on Cooperation in the Enforcement of Penal Sentences

On 5 August 2009, Mr. Kasit Piromya, Minister of Foreign Affairs of the Kingdom of Thailand and Mr. Hor Namhong, Deputy Prime Minister and Minister of Foreign Affairs and International Cooperation of the Kingdom of Cambodia, have signed the Agreement between the Kingdom of Thailand and the Kingdom of Cambodia on the Transfer of Sentenced Persons and on Cooperation in the Enforcement of Penal Sentences. On 24 August 2009, Cambodia and Thailand have notified each other in writing that their respective requirements for the entry into force of the Agreement have been completed in accordance with their respective internal legal procedures. By virtue of its Article 12 (1), the said Agreement therefore entered into force on 24 August 2009.

This Agreement marks another dimension in cooperative endeavour, covering the judicial field between the two countries. Thailand attaches great importance to the objective of this Agreement as it aims to facilitate the principle of rehabilitation. The Agreement provides particular measures for sentenced persons who have served the minimum periods of imprisonment to be transferred in order to serve their remaining sentences in their own countries. This will help sentenced persons to reintegrate themselves more effectively into their own society. This Agreement also serves as a framework to strengthen cooperative endeavour in law enforcement, and the administration of justice and for the benefit of sentenced persons of each respective state based on humanitarian grounds.
