ยาสูบแบ่งเป็นประเภท บุหรี่ ซิการ์ ยาสูบ รวมถึงยาสูบ(unmanufactured) ของจีนไม่ได้ใช้สูบเป็นหมวดสินค้าที่ต้องเสียภาษีต้องมีใบอนุญาตการนำเข้าสินค้าเข้าประเทศ ส่งออกไปต่างประเทศ และมีการเสียภาษีสำหรับการเก็บสินค้าใน wherehouse ซึ่งไม่มีการยกเว้นการเสียภาษี ใบอนุญาตดังกล่าวต้องมีการขอสำหรับสินค้าที่มีการเคลื่อนย้ายอย่างไรก็ตาม ไม่ต้องขอใบอนุญาตสำหรับสินค้าที่จ่ายภาษีแล้วการลงโทษสำหรับผู้ฝ่าฝืดถูกปรับสูงสุด $1,000,000 และจำคุก 2 ปี หากมีการผิดกฎหมายเพื่อหลีกเหลี่ยงภาษี มีการปรับเพิ่มเป็น 10 เท่าของจำนวนภาษีที่จะต้องจ่าย
สำหรับตัวเลขการขายผลิตภัณฑ์ยาสูบในฮ่องกงจะไม่มีบันทึกไว้ หากเป็นตัวเลขจำนวนมูลค่าการเสียภาษีบุหรีซึ่งในปี พ.ค.2549 มีจำนวน 287.493 ล้านม้วน ถึงปัจจุบัน(พฤษภาคม 2551) มีจำนวน 288.936 ล้านม้วน มีตัวเลขลดลงหลังจากรัฐบาลได้ประกาศการสูบบุหรี่ภายนอกอาคารและบังคับไม่ให้สูบบุหรี่ในร้านอาหารหรือบาร์ คลับต่างๆ
การนำเข้า
บุหรี่(HS 240220) ฮ่องกงมีปริมาณการนำเข้าในปี 2551 ยอดนำเข้ารวม 421,445 ล้านเหรียญสหรัฐ และในปี 2552 มียอดการนำเข้าระหว่างมกราคม- กรกฎาคม เท่ากับ 267,470 ล้านเหรียญฯ ในช่วงปี 2551(ม.ค. —ก.ค.)มีการนำเข้าจากเนเธอร์แลนด์(22.7), มาเลเซีย(21.3%), จีน (16.8%) สิงคโปร์(14.2%), และ ญี่ปุ่น(12.1%)
ยี่ห้อบุหรี่ ที่จำหน่ายอยู่ในฮ่องกงมีมากกว่า 20 ยี่ห้อ และที่นิยมสูบได้แก่ Marlboro, Marlboro Light, Marlboro Menthol, Kent, Campi, Salam Winfield, ราคาประมาณ 25- 29 เหรียญฮ่อกง และจากจีนแผ่นดินใหญ่ เช่น Shuanxo ราคาอยู่ประมาณ 25 เหรียญฯ
ยาสูบ(HS 240290) ฮ่องกงมีการนำเข้า ปี 2551 ยอดนำเข้ารวม 36 ล้านเหรียญสหรัฐ และในปี 2552(ม.ค.-ก.ค.) มูลค่า 94 ล้านเหรียญสหรัฐ โดยมีการนำเข้าจากประเทศสเปนคิดเป็นสัดส่วน 77% และฝรั่งเศษ 22% ตามลำดับ
ใบอนุญาต Licence
บุคคลผู้ซึ่งนำเข้า ส่งออก, โกดังที่เก็บ และโรงงานผลิต ต้องมีการขออนุญาตก่อน
- ชนิดของใบอนุญาต มี 3 ชนิด คือ
(a) ใบอนุญาตนำเข้าและส่งออก สำหรับการนำเข้าและส่งออกสินค้าดังกล่าวหรือการผสมของสินค้าที่เสียภาษีจำนวน 4 ชนิด(ใบอนุญาตสำหรับการนำเข้าหรือส่งออกยาสูบที่ยังไม่เข้าโรงงาน)
(b) ใบอนุญาตโรงงานผู้ผลิต
(c) ใบอนุญาตโกดังเก็บสินค้า

การขอใบอนุญาต(Licence)
- การขอใบอนุญาตจะมีการจดทะเบียนการค้ากับ Business Registration Office ในฮ่องกง
- บุคคลที่จะขอใบอนุญาต ต้องสมัครในนามบริษัทและผู้สมัครต้องมีอายุเกิน 18 ปี
- ผู้ขอได้รับมอบหมายจากบริษัท และต้องเป็นชาวฮ่องกงหรือผู้ที่มีถิ่นฐานในฮ่องกงและถือบัตรประชาชน
- ผู้ขอต้องหลักฐานในการจ่ายภาษี

ระเบียบการส่งออก/นำเข้าบุหรี่ของฮ่องกง
1. บริษัท/ตัวแทนการค้านำเข้า/ส่งออก จะต้องมีใบอนุญาตนำเข้า/ส่งออก
2. Storage เก็บสินค้าบุหรี่ในฮ่องกง บริษัทต้องมี License และเมื่อมีการขนย้าย หรือนำสินค้าออกมาต้องขอ Permit ก่อน
3. ทุกซองบุหรี่จะมีฉลากแสดงปริมาณสารที่อยู่ในบุหรี่ Tar จำนวน เท่าไร รวมทั้ง Nicotine ด้วย ต้องมีสลากเตือน Health warning บนซองบุหรี่ เช่น SMOKING CAUSES RESPIRATORY DISEASES HKSAR GOVERNMENT HEALTH WARNING ทั้งภาษาอังกฤษ หรือภาษาจีน
4. ผู้นำเข้าสินค้าบุหรี่ ต้องมีการเสียภาษีนำเข้า ในอัตราดังนี้
(a) For each 1,000 cigarettes เรียกเก็บ HK$804
(b) Cigars ’’ HK$1035/kg
(c) Chinese prepared tobacco ’’ HK$197/kg
(d) All other manufactured tobacco ’’ HK$974/kg
except tobacco intended for
the manufacture of cigarettes
สำหรับในข้อ (a) บุหรี่ 1 ม้วน มีความยาวมากกว่า 90 mm (ไม่รวมความยาวของก้นกรอง) ในการคิดคำนวณภาษีถือเป็น 2 ม้วน

การขอใบอนุญาต (License)
Any person who imports, exports, stores and manufactures any of them is required to possess a relevant license.
1. ประเภทของใบอนุญาต
1.1 Import and Export License - for the import or export of any or combination of the four types of dutiable commodities. (License is also required for the import or export of unmanufactured tobacco and hydrocarbon oil which attract no duty.) Endorsement must however be sought in advance for the specific type of dutiable commodities to be imported or exported (A Special Import License is for keepers of licensed warehouses capable of storing not less than 500 kilolitres of hydrocarbon oil);
1.2 Manufacturer's License - for the manufacture of a specific type of dutiable commodities;
1.3 Warehouse License - for the storage of dutiable commodities.

3. รายละเอียดของผู้ขอจดทะเบียน
3.1 Application for a license should be made by a company registered with the Business Registration Office in Hong Kong
3.2 The person (applicant) making the application on behalf of the company must be 18 years of age or over
3.3 The applicant should have been appointed by the company as the responsible person for the intended activities of the license under application. He should normally be a Hong Kong resident holding a Hong Kong Identity Card. Otherwise, a Hong Kong resident holding a Hong Kong Identity Card should also be appointed as the second responsible person
3.4 The applicant must produce a proof of landlord or tenancy agreement (Stamp Duty Paid)
3.5 Applicants dealing in hydrocarbon oil product (i.e. petrol and diesel) or storing a large quantity of liquor must possess a relevant License for Storage of Dangerous Goods issued by the Fire Services Department.
